The demolition committee for the Ville-Marie borough has refused permission to developers Brandon Shiller and Jeremy Kornbluth to tear down a six-storey apartment building at 3477 Drummond St. and replace it with a 12-storey building.

The project lacks social acceptability, said Ste-Marie councillor Sophie Mauzerolle, who chairs the borough’s urban planning consultative committee, noting that nearly 500 residents had signed a petition objecting to the project. The residents said the proposed building would block their views on Mount Royal, be an eyesore, aggravate the lack of parking on the street, and cause noise and pollution during construction.

Mauzerolle also noted that the existing building is in perfectly acceptable condition.

“We are ecstatic,” said Norma Ishayek, a resident of Drummond St. who organized opposition to the project with Larry Elman.

“It just shows what a concerted team effort can accomplish,” said Elman.

There is a 30-day appeal period for the decision.

Shiller and Kornbluth bought the 32-unit building for $11 million on Oct. 30, 2019, and immediately issued eviction notices, claiming they intended to subdivide the apartments. However, they later decided to demolish it and construct a 107-unit building. Eight of the tenants, who included many longtime residents, initially contested the eviction at the Tribunal administratif du logement, but all eventually consented to leave.

A spokesperson for the developers said Monday that if permission to demolish were refused, the owners would subdivide the dwellings instead.

Stupid tenants who think they own the building. Hey, there's a reason you are called a "tenant". Means you own nothing! I can't believe an owner can't do what they want of their building. Pathetic!!!!!! Buy the building if you want a say on it, otherwise shut up, and pay your rent! If I was the owner, the pépines would already be crushing your living room!

Hopefully, you know the rules  but (you) are just having fun stirring the pot.  

If you want the rules to be changed, take another route.  The tenants as persons are not to blame: they are just fighting for their own interests.  Property owners do just the same in their own ways.  Rules as they currently stand may or may not be "appropriate", but the ins and outs ought to be examined closely before any changes are made.  Again, as I am arguing within the context of other discussions, Montreal is not unique.  Tenants and property owners have competing interests.  You will find academics on both sides of the argument.  Similarly, narratives based on actual facts/experiences over time can be found to support one's position.  Extremes are rarely optimal, whether on the side of total free-for-all or the almighty state deciding everything.  And of course, let us not forget that politics is part of the game.  If you are in the busines of owning and renting apartments, you know (or should) that it's more complicated than selling clothing for example.  But it can be very rewarding too; it is just not for everyone.

C'est pas t'en la faute de ACDF ici, ils ne faisaient qu'exécuter leur mandat. 

Certaines critiques des locataires sont légitimes, mais celles pour le manque de parking et le bruit pendant la construction... la terre s'arrêtera pas de tourner, tous les chantiers vont faire du bruit, c'est pas permanent. 

Sauf qu'on s'entend qu'avec ce promotteur... c'est pas le plus aimer à cause de ses pratiques... acheter l'immeuble, le vider sous un autre prétexte pour ensuite aller a la ville en demandant de pouvoir le démolir... c'était sûr que ça allait pas passer. De plus, on ne démolis plus juste pour démolir sans raison.

Quelle stratégie pitoyable. Depuis le début ils souhaitaient démolir l'édifice afin de le remplacer par plus haut et plus grand et non le rénover comme il l'ont faussement prétendu afin d'évincer des locataires. Sur ce coup-là je suis à 100% du côté des nymbies. :cool:

C’est certainement pas la faute de Acdf... C’est un très beau projet.

Malheureusement on donne beaucoup trop de place et d’importance aux nombrilistes-NIMBY. Les chialeux ont toujours raison semble-t-il.

Moi si j'achète un building, j'ai le droit de faire ce que je veux avec. Les locataires doivent savoir par définition qu'ils sont là "en attendant". Si tu veux être propriétaire de ton affaire, achète-le! Ben tanné. Ben ben tanné des locataires qui se croient tout permis, mais qui sont même pas capable de changer une ampoule sans contacter le propriétaire!

Tu as le droit d'être bien tanné, mais alors n'achète pas un immeuble locatif.  Personnellement, je n'en achète pas, parce que je ne souhaite pas jouer sur cette patinoire.  Ce n'est plus comme dans le temps de la relation harmonieuse de longue durée entre le petit propriétaire et son locataire.

Rocco, on s'entend pas sur tout, mais ici, plutôt d'accord, en autant que le cadre juridique soit respecté. Sinon, à ce quoi cadre juridique sert-il?

Nous avions un appartement à louer dans notre maison familiale. C'était une façon d'arrondir les coins. Quand je pense à tout ça, je me dis que jamais je ne m'organiserais pour avoir des locataires aujourd'hui. J'ai eu un ami à Val d'Or (ville qui manque de logements) qui préférait garder son logement du sous-sol vide, plutôt que d'avoir le trouble d'un locataire qui néglige le logement, fait trop de bruit, ou carrément d'enfuit dans la nuit avec 4 mois de loyer en retard. (vécu).

C'est beau de s'arroger des droits, mais il faut voir au dépends de qui. Et quiconque a un immeuble à entretenir sait ce que coûte le moindre des travaux. Sans parler des taxes.

Il y a deux faces à toute médaille, fût-elle bénie par le pape.
