  1. America’s triple A rating is at risk By David Walker Published: May 12 2009 20:06 | Last updated: May 12 2009 20:06 Long before the current financial crisis, nearly two years ago, a little-noticed cloud darkened the horizon for the US government. It was ignored. But now that shadow, in the form of a warning from a top credit rating agency that the nation risked losing its triple A rating if it did not start putting its finances in order, is coming back to haunt us. That warning from Moody’s focused on the exploding healthcare and Social Security costs that threaten to engulf the federal government in debt over coming decades. The facts show we’re in even worse shape now, and there are signs that confidence in America’s ability to control its finances is eroding. Prices have risen on credit default insurance on US government bonds, meaning it costs investors more to protect their investment in Treasury bonds against default than before the crisis hit. It even, briefly, cost more to buy protection on US government debt than on debt issued by McDonald’s. Another warning sign has come from across the Pacific, where the Chinese premier and the head of the People’s Bank of China have expressed concern about America’s longer-term credit worthiness and the value of the dollar. The US, despite the downturn, has the resources, expertise and resilience to restore its economy and meet its obligations. Moreover, many of the trillions of dollars recently funnelled into the financial system will hopefully rescue it and stimulate our economy. The US government has had a triple A credit rating since 1917, but it is unclear how long this will continue to be the case. In my view, either one of two developments could be enough to cause us to lose our top rating. First, while comprehensive healthcare reform is needed, it must not further harm our nation’s financial condition. Doing so would send a signal that fiscal prudence is being ignored in the drive to meet societal wants, further mortgaging the country’s future. Second, failure by the federal government to create a process that would enable tough spending, tax and budget control choices to be made after we turn the corner on the economy would send a signal that our political system is not up to the task of addressing the large, known and growing structural imbalances confronting us. For too long, the US has delayed making the tough but necessary choices needed to reverse its deteriorating financial condition. One could even argue that our government does not deserve a triple A credit rating based on our current financial condition, structural fiscal imbalances and political stalemate. The credit rating agencies have been wildly wrong before, not least with mortgage-backed securities. How can one justify bestowing a triple A rating on an entity with an accumulated negative net worth of more than $11,000bn (€8,000bn, £7,000bn) and additional off-balance sheet obligations of $45,000bn? An entity that is set to run a $1,800bn-plus deficit for the current year and trillion dollar-plus deficits for years to come? I have fought on the front lines of the war for fiscal responsibility for almost six years. We should have been more wary of tax cuts in 2001 without matching spending cuts that would have prevented the budget going deeply into deficit. That mistake was compounded in 2003, when President George W. Bush proposed expanding Medicare to include a prescription drug benefit. We must learn from past mistakes. Fiscal irresponsibility comes in two primary forms – acts of commission and of omission. Both are in danger of undermining our future. First, Washington is about to embark on another major healthcare reform debate, this time over the need for comprehensive healthcare reform. The debate is driven, in large part, by the recognition that healthcare costs are the single largest contributor to our nation’s fiscal imbalance. It also recognises that the US is the only large industrialised nation without some level of guaranteed health coverage. There is no question that this nation needs to pursue comprehensive healthcare reform that should address the important dimensions of coverage, cost, quality and personal responsibility. But while comprehensive reform is called for and some basic level of universal coverage is appropriate, it is critically important that we not shoot ourselves again. Comprehensive healthcare reform should significantly reduce the huge unfunded healthcare promises we already have (over $36,000bn for Medicare alone as of last September), as well as the large and growing structural deficits that threaten our future. One way out of these problems is for the president and Congress to create a “fiscal future commission” where everything is on the table, including budget controls, entitlement programme reforms and tax increases. This commission should venture beyond Washington’s Beltway to engage the American people, using digital technologies in an unparalleled manner. If it can achieve a predetermined super-majority vote on a package of recommendations, they should be guaranteed a vote in Congress. Recent research conducted for the Peterson Foundation shows that 90 per cent of Americans want the federal government to put its own financial house in order. It also shows that the public supports the creation of a fiscal commission by a two-to-one margin. Yet Washington still sleeps, and it is clear that we cannot count on politicians to make tough transformational changes on multiple fronts using the regular legislative process. We have to act before we face a much larger economic crisis. Let’s not wait until a credit rating downgrade. The time for Washington to wake up is now. David Walker is chief executive of the Peter G. April 29, 2009 By LANDON THOMAS Jr. LONDON — Tetsuya Ishikawa reaped the fruits of London’s financial boom, structuring and selling his small share of the complex securities that fueled both his professional rise and the uninterrupted economic growth of Britain. When the boom went bust last year, he lost his job at Morgan Stanley, along with about 28,000 other Londoners working in finance. Mr. Ishikawa, who has written a fictional memoir, has no plans to return to the City, as London’s banking district is known. But Britain’s revenue-starved Labor government will find no such escape. “By 2010, the U.K. will have the largest budget deficit in the developed world,” said Richard Snook, a senior economist at the Center for Economic and Business Research in London. “The problem is that the financial services industry has been a huge cash cow for the British government for the last 10 years and now it is going into reverse.” The country’s budget deficit has soared to 12 percent of gross domestic product; its public debt burden could soon reach 80 percent of annual economic output, a figure that would leave it roughly in the same position as Greece. But at a time when Britain more than ever needs a financial sector firing on all cylinders, its economic engine is conking out — for a number of reasons, including some that critics blame on the government. All told, more than 70,000 jobs in finance are expected to disappear over the next two to three years, a big chunk of the total estimated job losses of about 280,000 in London. The British government has poured hundreds of billions of pounds into preventing several of its largest banks from falling into bankruptcy as the extent of their bad bets became evident. But there is little prospect of a revival anytime soon, as the government is about to impose stiffer demands on banks to keep high capital ratios and to rely less on leverage and once-lucrative trading activities. That, combined with a more aggressive posture by the regulatory authorities to put a check on bonuses, is likely to hasten what has already been a sharp falloff in corporate and income taxes from the City. The economic contribution from the British financial sector, according to the Office for National Statistics, peaked at 10.8 percent of G.D.P. in 2007 — up from 5.5 percent in 1996, just before Labor took over. By comparison, the contribution from financial services in the United States to the American economy never exceeded 8 percent. In a bid to capture more revenue, the British government has decided to raise tax rates on the affluent, many of them working in finance. But the new top income tax rate of 50 percent for those earning at least £150,000, or $219,000, may only make things worse, said Mr. Snook, the economist. “These people are highly mobile and they will leave London,” he said. “The impact on public finances will be negative.” Britain’s top tax rate will soon rank fourth behind those of Denmark, Sweden and the Netherlands — not quite the advertisement one would expect from one of the world’s leading financial centers. In many ways, Mr. Ishikawa’s career tracked the credit explosion that has now imploded. When he began work as a lowly credit analyst in 2002, banks in London issued about £20 billion in securities linked to various mortgage instruments. His career took off as that figure surged to over £180 billion by 2008, when Mr. Ishikawa secured for himself a $3 million bonus from Morgan Stanley as a reward for peddling assets that turned out to be toxic. With that line of business virtually defunct, banks in the coming years must return to lower-risk and lower-return businesses like equity and bond underwriting, foreign exchange trading and traditional deal-making — businesses that may well be profitable, but can in no way make up for the loss of such a lush specialty. The Center for Economic and Business Research estimates that corporate and income taxes from the financial industry will shrink from 12 percent of the overall tax take in 2007 to 8 percent this year and perhaps lower in the years ahead, a prospect that could force Britain to increase its already substantial borrowing requirement. The crisis has humbled all financial centers, from Wall Street to Dubai. According to an index produced in Britain that ranks financial centers around the world, the City of London still comes out on top, closely followed by New York. The gap, though, between these two and Singapore, which is now third, is narrowing. Lord Adair Turner, the chairman of the Financial Services Authority, agrees that London as a financial center will be in for an adjustment and says that a large portion of the banking industry’s profit contribution to the economy was “illusory.” But even in a more restrictive environment, he points out, London’s importance as a global financial hub and the most valuable trading center in Europe will not go away. “The City is important today for the same reason it was important in 1890,” he said. As for Mr. Ishikawa, who is 30 and grew up in Britain as the son of a successful Japanese executive, he is putting his hopes into a new career as a writer. His book, “How I Caused the Credit Crunch,” chronicles the debauched excesses of the boom — he was briefly married to a Brazilian lap dancer — by lightly fictionalizing his six-year stint in finance. “I really don’t miss it,” he said, sipping a coffee near the building where he was laid off. “There are many more kids out there more hungry than me.” Like Faruq Rana, for example. Mr. Rana, the 26-year-old son of Bangladeshi immigrants, was born and reared in Tower Hamlets, a district abutting Canary Wharf that has Britain’s highest unemployment rate. From his window, he can see the towers of Citigroup and Barclays reaching into the sky and his ambition to one day work as a trader in one of those buildings soars nearly as high. “Every day when I wake up and open up my window, I can smell my job,” said Mr. Rana, who is a student in a government-financed program at Tower Hamlets College that prepares local youths for jobs in the financial industry.   3. It's looking like New York will follow fast on the heels of Illinois in deciding not to add a luxury tax for jewelry over $20,000. The American Watch Association sent an e-mail to members on Monday saying that while the New York State Legislature has agreed to tax increases to deal with a budget deficit, the luxury tax proposal is not part of it. The luxury tax would have also applied to aircraft costing more than $500,000, yachts over $200,000, cars that cost more than $60,000 and furs over $20,000. But don't go spending yet, high earners in New York will be feeling an increased pinch. Income taxes were raised one percentage point to 7.85 percent for couples with income over $300,000 and couples with more than $500,000 in income will pay 8.97 percent. The three-year tax increase is expected to add $4 billion to the state coffers this year.
  4. Ontario in decline: From Canada's economic engine to clunker Can Dalton McGuinty see the light and reverse the decay with his forthcoming budget? By Paul Vieira, Financial Post March 23, 2009 A month before Dalton McGuinty, the Liberal Ontario Premier, hit the election trail in the fall of 2007 to seek a second mandate, an ominous warning sign of the province's crumbling economic stature emerged that should have provided fodder for the campaign. An analysis from leading Bay Street economist Dale Orr said Ontarians' standard of living had plummeted -- from a peak of 15% above the Canadian average in the mid-1980s to just more than 5%. Accompanying the analysis was a warning of further erosion by 2010. Alas, the eye-opening report hardly generated buzz during the election campaign. Instead, most of the talk was about a Conservative proposal to provide government funding for faith-based schooling. Ontarians didn't warm to the idea and re-elected Mr. McGuinty's Liberals with another majority. Reflecting today on that report, Mr. Orr said his nightmare scenario for Ontario has unfolded as envisaged. If anything, the situation in the province may be worse. As the McGuinty government prepares to table its sixth provincial budget on Thursday, it does so knowing the province that was once the country's economic engine is now the clunker of the confederation. While former have-nots such as Saskatchewan post surpluses this fiscal year, Ontario is bleeding red ink--a cumulative two-year deficit of $18-billion. Ontario's dramatic decline comes as no accident. It was decades in the making, based on a combination of mismanaged public finances and the ascent of emerging economies at the expense of high-cost manufacturing. Upon taking office in 2003, Mr. McGuinty moved to pour tens of billions of dollars into improving government services -- health care, education and social programs targeting the downtrodden -- while neglecting the changing economic landscape. To help finance this agenda, he raised corporate taxes and slapped a health-care levy on households. These moves, analysts say, helped cement Ontario as one of the least attractive places for companies to invest. Analysts wonder whether the economic crisis is finally going to force Mr. McGuinty and Dwight Duncan, his Minister of Finance, to make tough choices on spending and undertake the kind of tax reform -- as displayed this week by New Brunswick-- that will help the province attract investment to offset heavy job losses in Ontario. Derek Burleton, senior economist at Toronto-Dominion Bank, said Thursday's budget presents a possible turning point for the province. "There is no doubt we are undergoing a period of transformation as some of the industries that have driven healthy gains in living standards are on the decline," said Mr. Burleton, who co-authored a report with TD chief economist Don Drummond last fall that called on the province to embrace a "sweeping" new economic vision. "Given the sizeable deficit the province faces, that will put increasing pressure on the government to prioritize." One of those priorities is for Mr. McGuinty to cease his preferred manner of dealing with difficulties in the industrial heartland -- funneling tens of millions of dollars to the manufacturing sector, particularly automotive, through targeted tax relief or direct subsidies. "What the province should have been doing over the years was to make the province more flexible in attracting new businesses and not diverting resources into declining sectors," said Finn Poschmann, vice-president of research at the C. D. Howe Institute, a Toronto-based think-tank that has been critical of Ontario's tax breaks for struggling sectors such as autos and forest products. "Do you want to steer resources to the sectors where the outlook is positive and growing? Or do you want to divert resources from these stars, which are more likely to generate the long-term employment and wage growth that Ontario is accustomed to?" The manufacturing sector, and its high-paying jobs, used to be the province's crown jewel. But as a component of Ontario's GDP, it has dropped from a peak of 23% in 2000 to roughly 18% on factors such as a richer Canadian dollar, higher energy costs and offshore competition. It is expected to fall further once the dust settles from this crisis. The province was largely able to mask the decline in manufacturing through a combination of a booming housing market, a surge in public sector hiring and a robust financial services sector. The financial crisis, however, has exposed those flaws. For the period starting in 2003, only Quebec and Nova Scotia have produced weaker growth than Ontario. Forecasts suggest Ontario was the only province whose economy shrank last year, and economists say it will record either the worst, or second-worst performance, among provinces this year. Scotia Capital, for instance, has Ontario's economy contracting 2.9% in 2009, and posting meagre growth of 1.4% in 2010, below the expected national average. Of the roughly 295,000 jobs lost in Canada since October, nearly half have come from the province. The result? Unemployment in Ontario, at 8.7%, is now higher than it is the United States (8.1%) and above Quebec's 7.9% jobless rate-- the first time that has happened in three decades. The news is not expected to get any better any time soon. "We believe that the unemployment rate in Canada's largest province should hit 10% by 2010, even if the automobile sector's restructuring plan works," said Sebastian Lavoie, an economist at Laurentian Bank Securities. Further, Mr. Lavoie said wage growth in the province is destined to take a hit. In the past, companies were forced to offer comparable wages and benefits based on what the Canadian Auto Workers would negotiate with the Detroit car makers. But Mr. Lavoie said that will no longer be the case, with CAW accepting salary freezes and making concessions on perks such as cost-of-living-allowance. The financial crisis has just exacerbated a growing trend, said Mary Webb, senior economist at Scotia Capital. Ontario's receipts from foreign-bound exports last year represent an 11.7% drop from a peak of $185.1-billion recorded in 2000. For the same time period, Quebec's receipts fell by just 2.9%. For the rest of Canada, excluding Ontario and Quebec, receipts have surged a whopping 72%. Compounding Ontario's problem is the emergence of big deficit, fuelled in part by shrinking tax revenue and years of escalated program spending. Under Mr. McGuinty, program spending now stands at $23-billion per year more than when he took office in October, 2003, an increase of 36%. In fiscal year, 2007-08, program spending climbed more than 10% to $87.6-billion, compared with a 5.4% increase in tax revenue. Observers note Mr. McGuinty's ascent to power in 2003 can be attributed to a desire for change among Ontarians after years of the hard-nosed, right-leaning Conservative regime that earned scorned for cutting government services. Mr. McGuinty's two terms have been dominated by a push to restore spending on public goods such as education, health care, infrastructure and social services. Analysts say Mr. McGuinty was on the right track to bolster some key building blocks, such as post-secondary education. To help pay for this, Mr. McGuinty raised the corporate tax -- to 14% from 12% --in his first budget. "The balance of [McGuinty's] approach was not quite right," said Jack Mintz, public policy professor at the University of Calgary and renowned tax expert. "The problem was trying to [reinvest in public services] while at the same time trying to maintain a vibrant industrial sector." Mr. Mintz and other analysts say Ontario's tax regime, as currently structured, is suffocating the province's ability to attract investment and rebuild the economy. Last year, Jim Flaherty, the federal Finance Minister, suggested the tax system was making Ontario the "last place" businesses wanted to invest. Mr. Flaherty took lots of heat for that remark, but he was on to something. Mr. Mintz's research indicates the province's marginal effective tax rate on capital, which encompasses all levies slapped on investment in the province, stands at 35%, six points higher than the Canadian average, 29%. Further, the Ontario rate ranks as the ninth-highest in the world, tied with Japan. Despite moves to eliminate capital tax in 2010, and other business tax reductions from the federal government, Ontario's marginal rate is expected to drop only three points to 32% by 2012 -- still higher than all provinces and exceeding the national average. "Ontario will not be successful in retaining existing businesses and attracting new ones if its taxation system is not on sound competitive footing with other provinces and countries," said the TD report by Messrs. Burleton and Drummond. There are signs that Mr. McGuinty is acknowledging the need to change. Despite previous opposition, he said in January the province would take a "long, hard look" at harmonizing its provincial sales tax with the GST. As currently structured, Ontario's sales tax derives almost half of its revenue from taxing business inputs such as productivity-enhancingequipment. Harmonizing with the GST would shift the tax burden to households, but economists argue it would boost business investment and make Ontario more attractive. In a C. D. Howe research paper he released yesterday, Mr. Poschmann said putting an end to the "archaic" sales tax and harmonizing with the GST would move Ontario from a high-tax jurisdiction to a medium-tax jurisdiction by 2012, with the marginal rate on investment falling just over 10 percentage points. A signal toward sales tax harmonization could be contained in Thursday's budget, although observers are hedging their bets given the potential voter backlash. Any further moves on taxation, whether business or personal, may have to wait given the province's monster deficit and an unwillingness to give up further revenue to fund public service initiatives. "Ontario is going to be deeply challenged," Mr. Mintz said, "because it is going to be very hard for the government to do anything when you are so fiscally restrained-- unless it wants to make the deficit even bigger now." Glen Hodgson, senior vice-president and chief economist at the Conference Board of Canada, said the needed tax reductions would not see the light of day until Ontario decides what to do about health-care spending, which is growing at an annual clip of 8% to 10% and is the single biggest expense item in the budget. "This is a catalytic moment for the province," Mr. Hodgson said. "The light bulb has gone on, but it is not burning brightly yet. A lot of people would like to return to the Old World. But I think the Old World is gone -and that's the dilemma Ontario faces." --------- MANITOBA, N.B. SET EXAMPLE: As Ontario attempts to pull itself out of its economic quagmire, it can look to the provinces of Manitoba and New Brunswick for leadership. While the recession is expected to hit every province, Manitoba comes out near the top in most forecasts as one of the country's better performers in 2009. In its outlook, the Conference Board of Canada projects slight growth in the province of 1%, powered by infrastructure projects and tax cuts. Jack Mintz, public policy professor at the University of Calgary, said Manitoba was, along with Ontario, considered a high-tax jurisdiction for business investment. But the government has moved and Manitoba's marginal effective tax rate on investment dropped from 37% in 2007 to 33.8% last year. It is now scheduled to fall to 26.7% by 2012. "It is on the high side, but it will be closer to the national average" in 2012,Mr. Mintz said. "From the point of view of people who need to make investment decisions now, they know these changes are in place over the next several years. So Manitoba looks more appealing." Manitoba also benefits from having one of the most diversified economies in Canada. Roughly 30% of its economy is agriculture, which is more resilient to economic downturns. Further, Manitoba has a diversified manufacturing base with aerospace and buses playing key roles - and, unlike autos, demand for those products continues to be fairly solid. It also has abundant, cheap hydroelectricity. In contrast, questions abound over the reliability of Ontario's power grid, especially in light of the 2003 blackout that blanketed the province and much of the U.S. northeast. Meanwhile, analysts have applauded New Brunswick for taking aggressive steps on taxation this week in an effort to make the province more attractive for both investors and workers. The main change is the replacement of the existing four-bracket personal income tax structure to a simpler two-bracket structure by 2012. The lowest rate will be 9% for workers earning less than $37,893. Beyond that threshold, a flat tax of 12% will be applied. Perhaps more stunning, however, is that New Brunswick plans to lower its general corporate tax rate from 13% to 12%, effective this year, and all the way down to 8% by 2012 - the lowest in the country. "The New Brunswick government appears to be relatively more proactive compared to other jurisdictions, taking bolder steps to improve its economic and fiscal roadmap," said Carlos Leitao, chief economist at Laurentian Bank Securities, in his analysis of the province's budget. USA : Food Riots, Tax Rebellions By 2012...Trend forecaster, renowned for being accurate in the past, says LIVELEAK The man who predicted the 1987 stock market crash and the fall of the Soviet Union is now forecasting revolution in America, food riots and tax rebellions - all within four years, while cautioning that putting food on the table will be a more pressing concern than buying Christmas gifts by 2012. Gerald Celente, the CEO of Trends Research Institute, is renowned for his accuracy in predicting fut More..ure world and economic events, which will send a chill down your spine considering what he told Fox News this week. Celente says that by 2012 America will become an undeveloped nation, that there will be a revolution marked by food riots, squatter rebellions, tax revolts and job marches, and that holidays will be more about obtaining food, not gifts. "We're going to see the end of the retail Christmas....we're going to see a fundamental shift take place....putting food on the table is going to be more important that putting gifts under the Christmas tree," said Celente, adding that the situation would be "worse than the great depression". "America's going to go through a transition the likes of which no one is prepared for," said Celente, noting that people's refusal to acknowledge that America was even in a recession highlights how big a problem denial is in being ready for the true scale of the crisis. Celente, who successfully predicted the 1997 Asian Currency Crisis, the subprime mortgage collapse and the massive devaluation of the U.S. dollar, told UPI in November last year that the following year would be known as "The Panic of 2008," adding that "giants (would) tumble to their deaths," which is exactly what we have witnessed with the collapse of Lehman Brothers, Bear Stearns and others. He also said that the dollar would eventually be devalued by as much as 90 per cent. The consequence of what we have seen unfold this year would lead to a lowering in living standards, Celente predicted a year ago, which is also being borne out by plummeting retail sales figures. The prospect of revolution was a concept echoed by a British Ministry of Defence report last year, which predicted that within 30 years, the growing gap between the super rich and the middle class, along with an urban underclass threatening social order would mean, "The world's middle classes might unite, using access to knowledge, resources and skills to shape transnational processes in their own class interest," and that, "The middle classes could become a revolutionary class." In a separate recent interview, Celente went further on the subject of revolution in America. "There will be a revolution in this country," he said. "It’s not going to come yet, but it’s going to come down the line and we’re going to see a third party and this was the catalyst for it: the takeover of Washington, D. C., in broad daylight by Wall Street in this bloodless coup. And it will happen as conditions continue to worsen." "The first thing to do is organize with tax revolts. Mayor wants answers on city issues The Gazette Published: 6 hours ago Montreal Mayor Gérald Tremblay has written a letter to Jean Charest to find out where the Liberal leader stands on issues that are important to Montreal. Tremblay said he would like Charest to outline his government's plan for the city. He said improving the economy of Montreal will yield economic spinoffs in the rest of the province as well. In the letter, dated Nov. 12, Tremblay said he is anxious to hear Charest's proposals on how to "give Montreal the tools to properly assume its role as the economic motor of the province." Tremblay outlined several key areas his administration is working on that need government support: - A 20-year $8.1-billion transportation plan, which outlines major projects to renovate roads, improve public transit, and add bicycle paths. He said Charest needs to commit major public funds to help this project along. - Tremblay said the province must work to accelerate several infrastructure projects that have been stalled for many years, including the modernization of Notre Dame St. in Montreal's east end, the English and French superhospitals, and the revitalization of the harbourfront, which includes moving the Bonaventure Expressway away from the shoreline. - Tremblay also asked Charest to invest in urban renewal projects and to commit money for new social housing units. - He asked the province to help finance a new waste management plan, and to invest in the city's universities, research centres and museums. Tremblay also said Charest needs to work with Prime Minister Stephen Harper to free up Montreal's share of an $8.8 billion infrastructure program pledged in the federal government's 2007 budget. The funds have not yet been passed on to Canadian cities because of a complex application process for project approval and other delays in negotiations between the federal and provincial governments. Tremblay said it's imperative Montreal get access to that money now, to offset the effects of an economic downturn. He added Quebec also needs to change some of the rules governing cities to to give them access to new sources of revenue. Tremblay has been asking for a share of the Quebec sales tax or the ability to implement an entertainment tax on the island of Montreal. His administration has also mulled the idea of imposing tolls to drivers coming onto the island of Montreal. The city would need the permission of the Quebec government before imposing a new tax.

After years of benefiting from consumer bingeing on everything from luxury lofts to US$99 hamburgers, New York is seeing a dramatic turn in its fortunes as Wall Street stumbles. Investment banks and other financial-services firms here have cut tens of thousands of high-wage jobs and many more pink slips still could be on the way as they grapple with the deepening credit crisis. This year's Wall Street bonus pool, which makes up the bulk of the pay for high-flying financial executives, is forecast to be chopped in half to US$16-billion. Businesses are already feeling the pinch. Revenue at some high-end Manhattan restaurants are down an estimated 20% this year and the once sizzling real-estate market is cooling fast. New York City Mayor Michael Bloomberg said this week that the big drop in tax revenue collected from financial firms is forcing him to renege on planned US$400 property tax rebates for homeowners and to mull a 15% income tax hike. Economists said yesterday that the downturn could resemble New York's financial crisis in the early 1970s, when the city nearly went bankrupt and crime rates skyrocketed. "Compensation is going to be way down and that's going to weigh on restaurants and retailers and the housing market as well," said Mark Vitner, senior economist at Charlotte, N.C.-based bank Wachovia Corp. "We're going to have a very difficult climb back out of this. The recovery might begin in the middle of next year, but that just means things will stop getting worse." Mr. Vitner said it could take at least three years before New York starts to see strong growth and five years before the city gets back to normal. After the dot-com bust in 1999 and the Sept. 11 terrorist attacks, New York soon roared back, fueled by Wall Street's recovery. But the city can't depend on Wall Street this time around. "The flavour is different," said James Brown, a New York state Department of Labor regional analyst who focuses on New York City. "It's not clear how much growth we can expect from our financial sector in the next upturn. We don't know to what degree they may not be as profitable and able to lavish the same high salaries in the next boom as they have in the past booms." With the U.S. government looking to avoid sowing the seeds for a future financial crisis by cracking down on executive bonuses and limiting how much financial firms can wager, Wall Street's recovery could be slow. That's bad news for New York State, which depends on the financial sector for 20% of its revenue. The state already is facing its biggest budget gap in history, at US$47-billion over the next four years. The crisis last week prompted New York State Gov. David Paterson to ask U.S. Congress for billions of dollars in federal assistance. New York City has been particularly hard hit. For every Wall Street job another three or four will be lost in the city. Despite the doom and gloom, Mr. Bloomberg assured New Yorkers at a press briefing this week that the city wouldn't return "to the dark days of the 1970s when service cuts all but destroyed our quality of life." The mayor, who is seeking a third term to guide the city through the crisis, said New York is in much better fiscal shape than it was then and won't make the same mistakes. Still, he warned, it could be as many as five years before financial companies have to start paying city or state taxes again because of the half a trillion dollars in write-downs they have taken, which will offset future profits.
  8. Senate passes bailout Plan to buy $700B in troubled assets wins OK. Backers hope add-ons will yield more yes-votes in House. By Jeanne Sahadi, CNNMoney.com senior writer Last Updated: October 1, 2008: 10:20 PM ET NEW YORK (CNNMoney.com) -- The Senate on Wednesday night passed a sweeping and controversial financial bailout similar in key ways to one rejected by the House just two days earlier. The measure was passed by a vote of 74 to 25 after more than three hours of floor debate in the Senate. Presidential candidates Sens. Barack Obama, D-Illinois, and John McCain, R-Arizona, voted in favor. Like the bill the House rejected, the core of the Senate bill is the Bush administration's plan to buy up to $700 billion of troubled assets from financial institutions. Those assets, mostly mortgage-related, have caused a crisis of confidence in the credit markets. A major aim of the plan is to free up banks to start lending again once their balance sheets are cleared of toxic holdings. But the Senate legislation also includes a number of new provisions aimed at Main Street. The changes are intended to attract more votes in the House, in particular from House Republicans, two-thirds of whom voted against the bailout plan. The House is expected to take up the Senate measure for a vote on Friday, according to aides to Democratic leaders. The legislation, if passed by the House, would usher in one of the most far-reaching interventions in the economy since the Great Depression. Advocates say the plan is crucial to government efforts to attack a credit crisis that threatens the economy and would free up banks to lend more. Opponents say it rewards bad decisions by Wall Street, puts taxpayers at risk and fails to address the real economic problems facing Americans. "If we do not act responsibly today, we risk a crisis in which senior citizens across America will lose their retirement savings, small businesses won't make payroll ... and families won't be able to obtain mortgages for their homes or cars," said Senate Majority Leader Harry Reid, D-Nev., moments before the vote. In a press briefing after the vote, Senate Minority Leader Mitch McConnell. R-Ky., said, "This is a measure for Main Street, not Wall Street. [it will help] to unfreeze our credit markets and get the American economy working again." Because of Senate add-ons, the bill's initial price tag will be higher than the $700 billion that the Treasury would use to buy troubled assets. But over time, supporters say, taxpayers are likely to make back much if not all of the money the Treasury uses because it will be investing in assets with underlying value. How the Senate bill differs The package adds provisions to the House version - including temporarily raising the FDIC insurance cap to $250,000 from $100,000. It says the FDIC may not charge member banks more to cover the increase in coverage. But that doesn't prevent the agency from raising premiums to cover existing concerns with the insurance fund, according to Jaret Seiberg, a financial services analyst at the Stanford Group, a policy research firm. Instead, the bill allows the FDIC to borrow from the Treasury to cover any losses that might occur as a result of the higher insurance limit. The bill also adds in three key elements designed to attract House Republican votes - particularly popular tax measures that have garnered bipartisan support. It would extend a number of renewable energy tax breaks for individuals and businesses, including a deduction for the purchase of solar panels. The Senate bill would also continue a host of other expiring tax breaks. Among them: the research and development credit for businesses and the credit that allows individuals to deduct state and local sales taxes on their federal returns. In addition, the bill includes relief for another year from the Alternative Minimum Tax, without which millions of Americans would have to pay the so-called "income tax for the wealthy." The debate over extending AMT relief is an annual political ritual. It enjoys bipartisan support but deficit hawks on both sides of the aisle contend the cost of providing that relief should be paid for. Others argue it shouldn't be paid for because the AMT was never intended to hit the people the relief provisions would protect. Nevertheless, lawmakers pass the measure every year or two. How Senate bill mimics House version For all the sweeteners added to the Senate bill, however, it is similar to the House bill in many key ways. The core is the Treasury's proposal to let financial institutions sell to the government their troubled assets, mostly mortgage-related. And as in the House bill, the Senate would only allow the Treasury access to the $700 billion in stages, with $250 billion being made available immediately. The Senate bill is also similar in that it includes a number of provisions that supporters say would protect taxpayers. One would direct the president to propose a bill requiring the financial industry to reimburse taxpayers for any net losses from the program after five years. And the Treasury would be allowed to take ownership stakes in participating companies. Like the House version, the Senate bill includes a stipulation that the Treasury set up an insurance program - to be funded with risk-based premiums paid by the industry - to guarantee companies' troubled assets, including mortgage-backed securities, purchased before March 14, 2008. And it would place curbs on executive pay for companies selling assets or buying insurance from Uncle Sam. One provision: Any bonus or incentive paid to a senior executive officer for targets met would have to be repaid if it's later proven that earnings or profit statements were inaccurate. Lastly, the Senate version would set up two oversight committees. A Financial Stability Board would include the Federal Reserve chairman, the Securities and Exchange Commission chairman, the Federal Home Finance Agency director, the Housing and Urban Development secretary and the Treasury secretary. A congressional oversight panel, to which the Financial Stability Board would report, would have five members appointed by House and Senate leadership from both parties. Differing views Despite the Senate bill's sweeteners, the bill did not garner unanimous support because those who oppose the Treasury plan felt passionately it was the wrong approach. Sen. Maria Cantwell, D-Wash., a champion of the energy tax breaks in the bill, said on Wednesday afternoon she nevertheless would vote against the bill because she opposes "giving the keys to the Treasury over to the private sector." Opponents of the bill have said they resented being given a "my way or the highway" choice to address what they acknowledge is a very serious economic threat. During the Senate debate on Wednesday, Sen. David Vitter, R-La., characterized the administration's request to lawmakers 12 days ago as "crying 'Fire!' in a crowded theater, then claiming the only [way out] is to tear down the walls when there are many exit doors." Sen. Richard Shelby, R-Ala., said the Senate will have "failed the American people" by acting hastily. "I agree we need to do something. ... [but] we haven't spent any time figuring out whether we've picked the best choice." Supporters of the bill say they hate the position they are in and are angry, too, but say it's better to do something now than to let the credit crunch persist. "There's no doubt that there may be other plans out there that, had we had two or three or six months to develop ... might serve our purposes better," said Obama during the floor debate. "But we don't have that kind of time. And we can't afford to take a risk that the economy of the United States of America and, as a consequence, the worldwide economy could be plunged into a very, very deep hole." Potential costs The tax provisions of the Senate bill - the bulk of which come from the addition of tax breaks from other legislation - may reduce federal tax revenue by $110 billion over 10 years, according to estimates from the Joint Committee on Taxation. More than half of that is due to the 1-year extension of AMT relief. The Congressional Budget Office said it cannot estimate the net budget effects of the troubled asset program because of the many unknowns about that piece of the bill. However, the agency noted in a letter to lawmakers on Wednesday, it expects the program "would entail some net budget cost" but that it would be "substantially smaller than $700 billion." Overall, the CBO said, "the bill as a whole would increase the budget deficit over the next decade." All eyes on House Now the fate of the bailout rests with the House. "The reality has hit some members," said House Financial Services Chairman Barney Frank, D-Mass., late Wednesday on CNN. "The main change is reality - it's not possible now to scoff at the predictions of doom if we don't do anything." The lead House Republican, Rep. John Boehner, R-Ohio, was consulted on the Senate's plans and gave his "green light," spokesman Kevin Smith said. "We believe we'll have a better chance to pass this bill than the one that failed [Monday]," he added. The plan could attract House Republicans while simultaneously alienating bailout supporters among the Democrats because the tax cuts in the revenue bill aren't offset by spending cuts or increased revenues. President Bush, following the Senate vote, said the bill was central to the "financial security" of the nation. Most of the city’s American buyers spend winters in Florida or California and summers in Montreal, she added. European buyers tend to look for homes in the mountains, not in Montreal itself. Meanwhile, many Canadian empty-nesters are moving back to the city, looking for “something chic and exclusive,” she said. MARKET OVERVIEW Sandra Girard, senior analyst of the Montreal market for the Canadian Mortgage and Housing Corporation, says the market has been less active this year than it was in 2007. According to Ms. Girard, the number of transactions in the first half of 2008 was 3 percent lower than in the same period last year. However, 2007 broke records for the number of real estate transactions, making a slight slow-down inevitable, because “the activity registered in 2007 is difficult to sustain.” Meanwhile, sales prices continue to increase at a slower rate. Ms. Girard said overall prices for residential real estate increased 4 percent in the first half of 2008, compared to 8 percent in the same period last year. Ms. Latreille says condominiums continue to be popular among buyers in Montreal. A report by the Canadian Mortgage and Housing Corporation and the Greater Montreal Real Estate Board shows that prices for single-family detached homes increased less than 2 percent in the 12-month period to June 2008, while condo prices increased more than 7 percent over the same period. BUYING BASICS Stéphane Hardouin, a notary and partner in the law firm Sylvestre Lagasse in Sherbrooke, Quebec, says legal fees in Quebec are usually 1,200 to 1,800 Canadian dollars ($1,146 to $1,719). If the property is financed, he said, buyers usually pay an additional 750 Canadian dollars ($716) to the notary, and a mortgage registration fee of 137 Canadian dollars ($131). Buyers pay for an inspection, costing 600 to 1000 Canadian dollars ($573 to $955). Mr. Hardouin says the seller pays around 1,000 Canadian dollars ($955) for a surveyor’s certificate, and also the real estate agent’s commission of 5 to 7 percent. A goods and services tax, or sales tax, is assessed on new homes and on real estate agent commissions, he said. This tax is 12.875 percent. Land transfer taxes in Canada are different for each province. In Quebec, transfer taxes are paid directly to the municipality, Mr. Hardouin said. Toronto : Moving on out - to 905 Crazy' property taxes have forced the hand of hundreds of T.O. businesses in recent years By BRYN WEESE, SUN MEDIA Three years ago, Les Liversidge packed up his successful law office and moved out of Toronto. He didn't go far. Liversidge took his practice, his law books and his taxes across Steeles Ave. into Markham. It wasn't a move he wanted to make, rather a "simple business decision" to escape Toronto's "crazy" taxes. He's far from alone. Hundreds, if not thousands of Toronto's businesses over the past several years have packed up their shops, factories and offices and moved to the 905. In the iconic Danforth area, for example, 30% of retailers there now won't be around next year, according to a neighbourhood business survey. Toronto's high commercial property taxes are making rents uncompetitive and unaffordable, city business groups say. 'MOM AND POP BAKERY' "If you're paying $10,000 in taxes for your little mom and pop bakery, you'd have to bake a lot of buns just to pay your tax bill," said Judith Andrew, vice-president of the Canadian Federation of Independent Business in Ontario, which has more than 4,000 members in Toronto. "I could see for many people, unless you absolutely had to be in the city, you'd want to run your business somewhere else." Liversidge sold his Willowdale office (a house he "loved" that had been converted into a commercial space) at Yonge St. and Steeles Ave. when it no longer "made sense" to keep it because of burdensome taxes. "I don't remember what my taxes were when I bought (the building) in 1992, which to me means they were not significant," Liversidge said. He recalls paying somewhere in the neighbourhood of $6,000 and $8,000 in taxes annually. But a dozen years later, thanks to property tax changes, provincial downloading, double digit spending and tax increases by city council, Liversidge's tax bill, like those of every business in Toronto, went through the roof. His taxes hit $27,000 a year by 2005. "More significant, I think, was a lack of predictability," Liversidge said. "I had no confidence that commercial real estate taxes would be controlled in any reasonable way," he said. He now rents about the same amount of space in a new, modest-sized three-storey office building. His rent is less than what his taxes were in 2004 in Toronto, even though the two buildings are only about five minutes apart. JOB GROWTH STAGNANT "I would much prefer to be in Toronto, but it makes no sense," Liversidge said. "If this building was located 300 yards south (on the other side of Steeles in Toronto), I don't think I could afford it." In 2005, the property taxes on a 250,000-square-foot office in the 905 were roughly $800,000 less than in Toronto. These numbers come from a study the City of Toronto conducted and are the most recent available. Business groups, however, maintain the numbers are still reasonably accurate and applicable today. As a consequence, employment growth in the 905 skyrocketed while job growth in the city has been stagnant and even suffered erosion. Between 2000 and 2006, the 905 region added more than 300,000 jobs while Toronto lost 23,700 jobs. Looking further back, over the past two decades, the 905 has added 800,000 jobs while employment in Toronto is still about 20,000 below its peak in 1989. Back in 2002, a city report optimistically projected 1.84 million new jobs would be created by 2031, a number officials now suggest is less a "goal" and more a "target." The falloff is in part attributable to migration of business, particularly small and medium-sized companies, in everything from manufacturing, and accommodation to administrative support and transportation. Toronto's commercial and industrial taxes are higher than its neighbours for several reasons. In part, relatively lower residential property taxes have put more of a burden on businesses operating in the city. "It's all well and good to cushion residents ... however, at a certain point, people don't have to be here and they do leave," Andrew said. Also in part, Toronto's business education tax rates are higher than those paid in the 905. That's supposed to change, but not until 2014. The bottom line, for business, is a tax disparity they can't afford to ignore. Cindy Anisman, a spokesman for Kingsdown Sleep Systems, credits moving from the intersection of Hwys. 401 and 400 to Vaughan two years ago with their company's growing success. Their facility in Vaughan is 120,000 square feet and employs more than 100 people. "We needed to expand our business, and the only place that you could actually find an area big enough was north in Vaughan," she said. "Taxes are lower, and utilities in a brand new building are a lot cheaper, too." 'NO-BRAINER TO MOVE' "It was a no-brainer to move," she added. "We're just sorry we didn't make this move earlier." Toronto officials are fully aware of the taxation problem, and council has passed several new measures to try to stop the bleeding. Three months ago, the city started a new program that allows manufacturers to improve their buildings or create a new building and get a "tax holiday" from higher taxes for a decade on the upgrade. "It's the first of its kind anywhere, I believe," Christine Raissis, director of the city's strategic growth and sector services, told the Sunday Sun. For the past few years, the city has also waived development charges on new commercial and industrial buildings, which it collects to pay for infrastructure such as roads and sewers. "We forgo those, partly on the basis that our business and commercial property taxes are higher, so we're trying to do what we can in the short term to balance that (tax) differential," said Randy McLean, the city's economic policy manager. "We're forgiving the front end development charges because we want the jobs." It makes a difference. For a 100,000-square-foot industrial or small office development, those charges would amount to $827,000. Toronto has also implemented a three-year-old plan to lower its commercial to residential property tax ratio to 2.5 to 1 within 10 years from its current 4-1 ratio -- to narrow the gap between what homeowners pay relative to business owners. It's still dramatically higher than ratios in 905 communities but Andrew from the CFIB said at least Toronto is "heading in the right direction." Other critics are less understanding. "The city's proposal to bring the tax ratio in line ... is worthless because, at a minimum you're looking at 10 years before they achieve that level," said Lionel Miskin, v-p of the Toronto Association of Business Improvement Areas. "And each year your taxes still go up, but the residential tax rate is going up faster than the commercial rate." "Maybe people will be happy about it in 10 years, if there is anyone working in the city anymore," he added. "I would say it is a crisis situation." But Toronto council isn't the only level of government responsible for this city's jobs and businesses relocating to the 905. Provincial education taxes are also a sore point. In 2007, the Ontario government unveiled plans to equalize business education taxes across the province. 'VITALITY IN THE CITY' Historically, Toronto's Business Education Taxes were significantly higher than those paid in the GTA and will remain higher until the province completes its equalization plan in 2014. Steven Sorensen, who chairs the Toronto Office Coalition, argues city and provincial measures need to be put in place sooner if the city is serious about retaining businesses and creating jobs. "I think the benefits of introducing these measures in a more prompt fashion would pay off many times over in terms of the economic growth and vitality in the city," he said. The city counters the cost of lowering the commercial tax ratio sooner would cost $600 million to $700 million. However, the argument of when to lower taxes may be moot. For the Toronto Association of Business Improvement Areas, the only real solution to the city's high business taxation woes is to develop a new taxation system. The BIA association believes Ontario's property tax assessment system, which regularly updates the tax value of properties, is flawed and unfair. The CFIB also thinks the city needs to focus on its core duties -- roads, public health, welfare and parks -- and curtail its spending habits to make Toronto more tax competitive. In fact, a recent survey of its Toronto members -- all of them small and medium-sized businesses -- found 86% think the city needs to eliminate wasteful spending. Among other things, the CFIB wants the city to contract out more services for competitive bidding, and do away with its fair wage policy, which requires private non-union companies doing work for the city to pay their employees city rates. But the city, for its part, rejects the notion Toronto's taxes are posing a crisis for the business community. In fact, the city argues, there are currently three new skyscrapers being built in the downtown core for a total estimated investment of about $1 billion. BANKS, STOCK EXCHANGE The city is still the financial capital of Canada, home to the headquarters of five of the country's six national banks, 90% of Canada's foreign banks and the nation's largest stock exchange. There is also growth in several important industries, namely computer systems, finance, health and education, which Raissis argues creates a synergy with the outlying areas of Toronto, whose specialty is mainly manufacturing. "The performance of 905 is important to Toronto, and the performance of Toronto is important to 905," she said. "It's one economic region, but it's not homogeneous." "We are not here to compete against the 905, we're all here as a region to present Toronto as an international market place," she said.

Tories looking for ways to cut gas price DANIEL LEBLANC Globe and Mail Update July 30, 2008 at 2:01 PM EDT LÉVIS, Que. — The Conservative Party will look over the next two days for ways to bring down the price of gas even though there is no room for major tax cuts, Finance Minister Jim Flaherty said. Speaking to reporters Wednesday morning, Mr. Flaherty said his constituents have clearly told him about the impact of high gas prices on their household budgets in recent weeks. However, Mr. Flaherty cautioned that “this is a time of economic slowdown” and that his government has no plans to drastically change its course in coming months. “This is not a year for big new spending projects or big new tax reductions,” he said. Still, Mr. Flaherty said that the Conservative caucus will be exploring solutions to high gas prices at its current two-day meeting, including looking at a variety of tax measures that will be proposed by MPs. However, Mr. Flaherty shot down the notion that he could use $4-billion in revenue from a recent auction of wireless spectrum to send cheques directly to taxpayers to offset their heating bills. Mr. Flaherty said it is likely that a portion of the auction funds will be used to pay down the debt. “Our preference is to have structural change,” he said. “You can't spend your way out of a situation like this.” On law and order, Justice Minister Rob Nicholson and Public Safety Minister Stockwell Day showed that the Conservatives will continue to press for tough measures against criminals as a way to differentiate themselves from its political opponents. “We are alone on this,” Mr. Nicholson said, promising to toughen the Youth Criminal Justice Act. Mr. Day said his government is also looking to improve security in prisons, including getting rid of rules that prevent the government from forcing inmates to work or that hinder proper searches for drugs in prisons. On federal-provincial relations, Transport Minister Lawrence Cannon said his government will continue to foster the autonomy of the provincial governments in their areas of jurisdiction. Mr. Cannon, who is the Quebec lieutenant in the Harper government, said his party's position is clearly different from the Bloc Québécois's focus on sovereignty and the Liberal Party's centralizing view. “Our autonomy position as a political party is to respect the Constitution as it was written,” he said. Conservative MP Maxime Bernier also addressed reporters, saying he has nothing more to say about the controversy over his relationship with Julie Couillard, a woman who had relationships with a number of people tied to criminal biker gangs.

The poll, conducted from June 10 to 12, found that 52 per cent of the 1,002 Canadians surveyed disagree with Bill C-10, a proposed change to the Income Tax Act that would deny tax money to filmmakers whose content is "contrary to public policy." At 62 per cent, residents of film-industry-heavy British Columbia are most likely to say the government is "wrong" to interfere in such a way. That's followed by those living in the mostly Conservative province of Alberta at 57 per cent, indicating the reaction of Canadians is largely ideological. "(The bill) has obviously touched a nerve," said John Wright with Ipsos Reid. "If it's not going to pass the sniff test, it's going to be gagged," said the senior vice-president of Ipsos Reid. "It has a good majority in the country that are going to go against this." Although the idea to deny tax credits was raised under the previous Liberal government, Wright suggests people may be concerned about the "slippery slope" of censorship with the Conservative Party. "While it may have been acceptable under the Liberals because they were more flexible on content, this government has the trappings of moral and religious rigour," he said. "So they might wear this more than the last government." According to the poll, 45 per cent of Canadians believe it's right for the government to screen the content of films, because it involves taxpayers' money - and because government has the right to determine what's in the public interest. As the poll was released, the Canadian independent film, Young People F*****g, opened in cinemas on the weekend. The film has become the poster child for the controversial bill that has many Canadian film and TV stars, including actress and director Sarah Polley, lobbying the government to stop the bill. The reason, say opponents of C-10, such as Polley, actor-director Paul Gross and Oscar-winning director Ang Lee, is that Young People is the type of film that would have been denied funding. Young People, a movie about four couples and a threesome trying to find satisfactory sex lives, has been viewed as pornographic by some religious groups, while others say it's just a bit of fun. In any case, the film is not as raunchy as its title suggests. Although there's a lot of nudity, mostly it's just a series of sketches where the characters seek to balance their lives with love and sex. The film's director, Martin Gero, says it's a harmless comedy, but he agreed it may not have got the funding had it been judged by the title. The poll found younger Canadians aged 18 to 34 were more likely to say the government is "wrong" to censor content by refusing tax credits, followed by Canadians age 35 to 54. Those with post-secondary education and those who live in urban areas were also more likely to disagree with the bill, the poll suggests. While the poll suggests a majority of Canadians disagree with the bill, the government argues the proposed change to the federal tax-credit system does not jeopardize the creative freedom of Canadian film and TV production. Senior government officials who spoke to journalists this week said a new "PVT" is the most likely new municipal revenue source to arise from the menu of options that Bill 22 would give Montreal. Bill 22 is the draft legislation tabled last fall to give Montreal new tax powers and make governance changes in the Montreal agglomeration. But the amendments are now calling for open-ended, royalty-type levies in their place. Although Mayor Gérald Tremblay has refused to be specific about the new taxes he has in mind, bureaucrats did bring up the possibility of a new tax on backyard swimming pools. And Tremblay conceded that many of the new taxes he is considering are inspired by some of the new taxing powers the city of Toronto won from the Ontario government in 2006. Royalties are traditionally applied to the use of a natural resource, like oil or water, but Toronto has taken the idea one step further and is considering a new tax on billboards, for the use of public space. The Bill 22 amendments are said to have sufficient opposition-party support to be approved before the legislature recesses next Friday. If that happens, Montreal will get the power to tax movables and immovables, but sales and inheritance taxes won't be allowed. Neither will taxes on gasoline, income, payrolls or energy. The new tax powers would be given only to the city of Mont- real, not to the 15 demerged island suburbs. Any new personal vehicle tax in Montreal would apply only to residents of city of Montreal boroughs. The most notable difference between Bill 22 and the city of Toronto Act is that Bill 22 stops short of allowing Montreal to tax alcohol and tobacco. "We're going to take time to look at our options," said Renée Sauriol, an aide to Tremblay. This idea of expanding the notion of royalties to the municipal level is something that Montreal finds intriguing. Quebec is proposing to give Montreal a lot of leeway to come up with inventive new royalty schemes. The proposal hasn't been received well by suburbanites and nothing has happened yet. In Montreal, the Tremblay administration has similarly begun to regionalize its own original proposal for new island bridge tolls. Mayor Gérald Tremblay, the mayors of the 15 island suburbs and prominent Quebec cabinet ministers announced they had brokered an accord to revamp the agglomeration council that manages island-wide services and has been a source of acrimony since the suburbs demerged from Montreal in 2006. Taxpayers in the suburbs would now receive one tax bill instead of two, while their cities and towns would regain control over maintenance of major roads in their areas and be spared millions of dollars in shared costs with Montreal. And, under a separate deal with Montreal, Quebec agrees to grant a long-standing wish of Tremblay and previous Montreal mayors for more clout and for the power to raise revenue through new forms of taxation. Both deals, signed at Montreal city hall yesterday, provide a package of amendments to Bill 22, legislation that was tabled in the National Assembly last year to resolve a power feud between Montreal and the suburbs. The amendments will be submitted to the National Assembly for a vote before the current session ends late next week. "In every step of this negotiation, we were looking for a win-win scenario," Municipal Affairs Minister Nathalie Normandeau said of the deals. "Today, we can say, 'Mission accomplished.' " Montreal acquires new power to tax assets and property in its territory and to claim royalties for use of resources. The deal also allows Montreal to walk away with $25 million a year in aid from the province starting in 2009, the power to unilaterally set the rate it charges for the "welcome tax" on property sales above $500,000 and a cheque of $9 million a year from the province to cover property tax on the Palais des congrès. The new, potentially sweeping tax power was inspired by the City of Toronto Act, Normandeau said. Using that legislation, Toronto is now creating a personal vehicle tax that it will begin charging car owners this fall. The Montreal deal would overhaul the governance of the downtown Ville Marie borough. It would also bestow status on the city as the metropolis of Quebec, which would be written into the city charter. As well, the deal would allow city council to centralize any borough responsibility in case of danger to health or safety by a majority vote for up to two years. And in response to criticism of the way the city bypassed its independent public-consultation office to approve the redevelopment of Griffintown this spring, the deal would extend the boroughs' power to initiate changes to the city's urban plan to the city council and require such changes to be sent to hearings by the public-consultation office. Tremblay refused to say what new taxes he would create. Anne de Bellevue, it will have to pay off not only the real estate developer that owns the forest but also the town that stands to lose tax revenue if it is not developed. At least, that's the view of Ste. Anne de Bellevue Mayor Bill Tierney. Developers plan to build about 60 homes on 13 hectares of mature forest in what is known as Woods No. 3, tucked between the Rivière à l'Orme and the town of Kirkland's western border. The site is within the borders of the Rivière à l'Orme Ecoforest Corridor, one of 10 ecoterritories the city of Montreal identified in 2004 as being ecologically significant. The Rivière à l'Orme ecoterritory is home to an unspoiled mature forest, rare and endangered flora and fauna, and cedar groves that provide habitat for a population of white-tailed deer. Montreal set aside $36 million to acquire private lands within the most sensitive parts of these 10 eco-territories in March 2004. The island council later expressed its support for Montreal's efforts by identifying these same ecoterritories as "heritage areas of collective interest." Ste. Anne de Bellevue is one of three municipalities through which the Rivière à l'Orme, the island's only inland river, flows. The Rivière à l'Orme Ecoforest Corridor includes land in Pierrefonds, Beaconsfield and Ste. Anne de Bellevue. While some island municipalities, like Beaconsfield, have welcomed Montreal's efforts to preserve ecologically valuable forests and wetlands in their communities, Tierney says Ste. Anne de Bellevue needs to grow and requires the tax dollars the new development would bring. Besides, Tierney says, Ste. Anne is already plenty green, thank you, what with McGill University's Macdonald Campus Farm, the Morgan Arboretum and the Ecomuseum. "This is not the middle of Montreal. This is not Verdun. It's already very, very green," Tierney said in an interview. The land in question has been zoned residential for at least 25 years, Tierney notes, and last year the town council adopted a development plan for the area confirming that zoning. In March, the developer was granted the right to subdivide the land and West Island conservation groups fear the felling of trees is imminent. "When Montreal decided to protect these green spaces, they did not have the force of law," Tierney said. "The only sure way Montreal can protect this land is to acquire it." The city of Montreal is trying to do just that. Helen Fotopulos, the city of Montreal executive committee member responsible for parks and green spaces, said negotiations are under way with the landowners, Groupe Immobilier Grilli Inc. and Jean Houde Construction. "I'm optimistic" Woods No. 3 can be saved, Fotopulos said. "For us this is a priority and always has been. ... The discussions are going on and we hope to be able to have our great-grandchildren enjoy the fruits of this forest." But Tierney said Ste. Anne de Bellevue should not be expected to stand by while Montreal butts in, buys the land and deprives his municipality of future tax revenues. He argues the cost of ecoterritories, including lost tax revenues, should be shared by taxpayers across the island. "Ste. Anne is not a rich city," Tierney said. "Maybe losing that money means not being able to meet our collective agreements or not bringing in programs like improved recycling and bicycle paths." The new housing development would be very eco-friendly, and include such features as geothermal heating and preservation of much of the tree canopy, he said. But a canopy does not a forest make, and conservation groups like the Green Coalition say Ste. Anne de Bellevue needs to get its eco-priorities straight. "This land is of the highest value in terms of ecology and how intact and undisturbed the forest is," said Daniel Oyama, of the Green Coalition, a non-profit advocacy group. He wants to see cities like Ste. Anne change their development plans to reflect the need to preserve what little is left of unspoiled green spaces on the island of Montreal. "They should get out of the woods and build in higher density on what's already been spoiled and leave the mature 100-year-old trees alone," Oyama said. Meanwhile, Beaconsfield Mayor Bob Benedetti said he, too, is confident Woods No. 3 will be preserved. Benedetti joined Fotopulos last year in Montreal's efforts to preserve part of Angell Woods, which also fall within the Rivière à l'Orme Ecoforest Corridor. But instead of demanding compensation money, Beaconsfield contributed $600,000 toward buying the land from the developer who owned it. "We were in a different situation," Benedetti said. "Our citizens had made a clear decision they wanted to preserve that forest." Benedetti sits on a committee set up by the island council to deal with issues related to the Rivière à l'Orme Ecoforest Corridor. He said it's significant Tierney has agreed to meet with the committee next month. Since Woods No. 3 is just across Highway 40 from Angell Woods, Benedetti is keenly interested in seeing it preserved, too. "I subscribe to the dream of a huge West Island regional park that would go from Cap St. Jacques down to Angell Woods on both sides of the Rivière à l'Orme, with a green corridor over or under Highway 40," he said.   16. Flat tax would make today's tax-filing ordeal simpler and more fair NIELS VELDHUISThe Gazette Wednesday, April 30, 2008 Today is the tax-filing deadline. As we hunkered down over our computers and waded through piles of receipts and pages of complicated forms this month, many of us rightly questioned the complexity of Canada's tax system. The total costs associated with paying personal income taxes and the cost of tax software and accounting services amount to upward of $3.9 billion a year. It need not be this way. If Canada adopted a flat tax, taxpayers could complete and file their taxes in about five minutes on a postcard-size tax form. A recent study, A Flat Tax for Canada, by tax expert and University of Stanford Professor Alvin Rabushka, proposes just that: a 15-per-cent flat tax and postcard-size tax returns for both individuals and businesses. The 15-per- cent flat tax would collect the same amount of revenue as the federal government currently collects but do so in a manner that is much less damaging and distorting. The flat tax would simplify Canada's tax code through the elimination of nearly all deductions, exemptions and credits that complicate the current tax system. For individuals, only a few basic calculations would be needed to determine the amount of tax owing or refund due. Simply add up one's income from wages, salaries, and retirement benefits; subtract the basic personal exemption (the amount of income individuals can earn tax free); and multiply the remainder by 15 per cent. Gone are the numerous and interlinked tax forms of the present personal-income-tax system; gone are the myriad of tax credits and deductions; and gone is the complicated and time-consuming paperwork. Individuals would no longer need to report income derived from such sources as dividends, capital gains, or interest, as these types of income would be taxed at their source - the business level. This means businesses would pay tax on all the income they generate except the income earned by workers. For approximately 85 per cent of Canadian taxpayers, filling out a postcard tax return would be all that is required to pay their income taxes. The self-employed and a few others would need to fill out an equally simple business tax form. For businesses, all income from the sale of goods and services would be subject to the flat tax. Deductions would be limited to the cost of materials, wages and salaries, and capital investments (buildings, equipment and land). Other income would be taxed at the same rate as individual income. Not only would a flat tax dramatically simplify the tax system, it would also have a significant impact on the Canadian economy. First, a flat tax would replace the existing four federal income-tax rates with one low rate thereby eliminating the barrier that discourages Canadians from saving, investing or working harder to earn more money. Research clearly shows that tax rates that increase as individuals earn more money through hard work act as a disincentive for such work. A flat tax would also have a significant impact on investment in Canada. Since businesses are permitted to deduct the full value of capital investments (buildings, equipment and land) in the year of purchase, the tax burden on investments would be significantly reduced and would increase the amount of investment undertaken by businesses. International evidence clearly shows that Canada would benefit greatly from a flat tax. In fact, more than 20 jurisdictions around the world, most notably Hong Kong and more recently a number of former Soviet republics, have implemented flat taxes. Hong Kong built itself into an economic giant using the flat tax as its fiscal anchor. Similarly, Slovakia, which adopted a flat tax in 2004, has since become Europe's fastest growing economy and a beacon for foreign investment. At this time of year most Canadians become frustrated at just how unwieldy, complicated, and littered with exemptions for special interests our tax code has become. Replacing Canada's personal and business income-tax system with a flat tax will save money, make everyone's taxes easier to calculate, and strengthen the Canadian economy. A few key strokes on a calculator, a minute or two to fill out a postcard return, and voilà, off to Ottawa, with love. Ottawa pledges tax cuts as surplus soars STEVEN CHASE Globe and Mail Update September 27, 2007 at 1:02 PM EDT The Canadian government racked up a monster surplus of about $14-billion for the last fiscal year, Ottawa reported Thursday. It said it has used the surplus to retire national debt and will funnel the $725-million interest saved as a result to Canadian taxpayers through tax cuts. That is a break of about $30 to $40 per tax filer in annual savings, depending on how it is allocated. That surplus far exceeds the $9.2 billion forecast in the last budget. (Photo: Studio Mel’s) Cinema industry: Montreal perks up The filming of blockbuster “The Mummy III” has been going on for a few days in the Cité du cinéma, which in itself is proof that the glorious days of filming in Montreal have returned after a difficult three-year period. American studios ignored our city and there was a decrease in production volume during that difficult time. When Brad Pitt arrived downtown in the spring to film “The Curious Case of Benjamin Button,” with director David Fincher, (who also directed the successful “Seven” and “Fight Club”), the whole city was excited to see the handsome husband of Angelina Jolie. The Quebec Cinema and Television Office (French acronym: BCTQ) believes that 2007 could generate a production volume beyond $250 million and sales of more than a billion dollars, half of which will go to salaries. That should meet the bread and butter of some 35,000 people who work in the 500 cinema companies in Quebec. In July alone, the results were past the half-way mark achieved in 2006, making up for the difficult three years we experienced. Twelve long Quebec films are in the process of shooting this summer, as well as 15 television series and four American films (a couple of which are “Mr. Nobody” and “Afterwards”). Michel Trudel, owner of Cité du cinéma, the largest cinematography centre in North America, confirms that 2007 “is a good year for the entire industry. Several conflicts since 2004 have now been settled on the part of unions and producers. These days, foreign film producers know which ones they should be working with and it’s going a lot better.” But Mr. Trudel already sees another conflict in the horizon for July 2008; that is, the conflict involving American actors. Will that be another blow for Montreal? “That can hurt us, since the studios will want to film quickly before summer, delaying other projects. If the conflict is not settled, it will be fatal because the damage will be done. The industry will slow down for several weeks or months”, Mr. Trudel explained. He manages 18 filming studios in Montreal and St. Hubert. Courting Hollywood is no easy task. More than 35 states now have incentives and tax cuts to attract the major California studios. Europe and East Asia also are increasingly offering their own incentives. “Our goal”, says Hans Fraiquin, (National Commissioner of the BCTQ) “is to continue to go higher and to ensure that Montreal becomes a production centre of international calibre. We have always been behind Toronto and Vancouver, but in three years, we hope to be on equal footing with them.” Tax credit for filming in the region Just before summer holidays and following a meeting with the Minister of Culture and Communications Christine Saint-Pierre, BCTQ officials insisted on the importance of “implementing more attractive and more competitive incentives”, Mr. Fraiquin explained. They have a higher fee for filming beyond these parameters. A 6%-7% credit, for example would attract film companies that would otherwise go elsewhere. That wouldn’t necessarily be expensive for us and would make us very competitive. Even Montreal and its workers would benefit, as well as the governments and regions.” According to him, the governments “will recover their investments significantly on taxes imposed on workers and taxes deducted left and right.
